1. Introduction
TABA Systems LLC ("PilotSchedule," "we," "us," or "our") operates PilotSchedule.com and the PilotSchedule aircraft scheduling and reservation application (the "Resources"). We respect your privacy and are committed to protecting your personal information. This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights you have.
This Policy applies to information we collect through our website, our application, and our communications with you. It works alongside our Terms of Service.
"Personal information" means information that identifies, relates to, or can reasonably be linked to an individual.
2. Information We Collect
Information you provide to us:
a. Account and registration information, such as your name, email address, mailing address, phone number, and the organization you represent.
b. Scheduling and operational information you enter into the application, such as aircraft details, reservations, member records, and instructor information.
c. Payment information you provide when you subscribe. Payment card and account details are collected and processed directly by our payment processors, as described in Section 6. We do not store full payment card numbers on our servers.
d. Communications you send us, such as support requests, survey responses, and feedback.
Information we collect automatically:
e. Usage and device information, such as your IP address, browser type, device type, pages viewed, referring pages, and the dates and times of your visits.
f. Cookies and similar technologies, as described in Section 7.
3. How We Use Your Information
We use the information we collect to:
a. Provide, operate, and maintain the Resources and your account.
b. Process your subscription, payments, and renewals.
c. Respond to your customer service and support requests.
d. Send administrative and transactional messages, such as confirmations, security alerts, and account notices.
e. Send newsletters, product updates, or marketing messages where permitted, from which you can unsubscribe at any time.
f. Improve, personalize, and develop the Resources.
g. Detect, prevent, and address security issues, fraud, and technical problems.

4. Legal Bases for Processing (EEA and UK users)
If you are located in the European Economic Area or the United Kingdom, we process your personal information on the following legal bases: to perform our contract with you (providing the Resources), for our legitimate interests (such as improving and securing the Resources), to comply with legal obligations, and with your consent where required (such as certain marketing communications). Where we rely on consent, you may withdraw it at any time.
5. How We Share Your Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share personal information only as described below:
a. Service providers. We share information with third parties that help us operate our business, such as our hosting provider, payment processors, email delivery provider, and website platform. These providers may access personal information only to perform services on our behalf and are required to keep it confidential.
b. Payment processors. Subscription payments are processed by PayPal and Stripe, as described in Section 6.
c. Legal and safety. We may disclose information when we believe it is appropriate to comply with the law, enforce our policies, or protect the rights, property, or safety of PilotSchedule, our users, or others.
d. Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or control that affects your personal information.
6. Payment Processing
Subscription payments are handled by our third-party payment processors, currently PayPal and Stripe. When you make a payment, your payment details are collected and processed by the applicable processor through a secure connection and are not stored or processed on our servers. Your use of these processors is subject to their own terms and privacy policies.
7. Cookies and Tracking Technologies
Cookies are small files that a website transfers to your device through your web browser (if you allow it) that enable the site to recognize your browser and remember certain information.
We use cookies and similar technologies to:
a. Keep you signed in and maintain your session.
b. Remember your preferences and settings.
c. Understand how visitors use our website through aggregate analytics, so we can improve the Resources.
Analytics. We use analytics services, including Wix Analytics (provided by our website platform, Wix) and Google Analytics, to understand how visitors find and use our website. These services use cookies and similar technologies to collect information such as your IP address, browser and device type, pages visited, and how you interact with our site, and they report aggregate trends to us. Google Analytics is provided by Google and is subject to Google's privacy policy. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout.
You can set your browser to warn you when a cookie is being sent, or to refuse cookies. Because each browser is a little different, look at your browser's Help menu to learn the correct way to modify your cookies. If you turn cookies off, some features of the Resources may not function properly.
8. Data Retention
We retain your personal information for as long as your account is active and as needed to provide the Resources. After your account is closed, we retain and use your information only as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements, after which we delete or anonymize it. You may request an export of your scheduling data before closing your account.
9. How We Protect Your Information
We use a range of security measures to protect your personal information. Sensitive information you provide is encrypted in transit using Transport Layer Security (TLS). Personal information is kept behind secured networks and is accessible only to a limited number of people who have special access rights and are required to keep the information confidential. We scan our systems regularly for security vulnerabilities. No method of transmission or storage is completely secure, so while we work to protect your information, we cannot guarantee absolute security.
10. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
a. The right to access the personal information we hold about you.
b. The right to correct inaccurate or incomplete information.
c. The right to request deletion of your personal information.
d. The right to restrict or object to certain processing.
e. The right to data portability.
f. The right to withdraw consent where processing is based on consent.
If you are in the European Economic Area or the United Kingdom, you also have the right to lodge a complaint with your local data protection authority.
If you are a California resident, you have the right to know what personal information we collect and how we use and disclose it, the right to request deletion or correction of your personal information, and the right not to receive discriminatory treatment for exercising your rights. We do not sell your personal information and do not share it for cross-context behavioral advertising.
You can exercise these rights, or update your account information at any time, by logging in to your account or by contacting us using the details in Section 17. We will respond within the timeframes required by applicable law.
11. International Data Transfers
We are based in the United States, and our service providers may store and process information in the United States and other countries. If you access the Resources from outside the United States, you understand that your information may be transferred to, stored, and processed in a country whose data protection laws may differ from those of your country. Where required, we take steps to ensure your information receives an adequate level of protection.
12. Do Not Track
Some browsers offer a "Do Not Track" (DNT) signal. Because there is no common industry standard for interpreting DNT signals, we do not currently respond to them differently. We do not track our users across third-party websites to serve advertising.
13. Children's Privacy
The Resources are intended for adults and are not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.
14. Third-Party Links
The Resources may occasionally include links to third-party products, services, or websites. These third-party sites have their own separate and independent privacy policies, and we have no responsibility or liability for their content or activities. We encourage you to review the privacy policy of any third-party site you visit.
15. Email Communications and Your Choices
We may collect and use your email address to respond to inquiries, process your subscription, send information and updates about your account, and send marketing messages to our mailing list where permitted.
In accordance with the CAN-SPAM Act, we agree to the following:
a. We will not use false or misleading subject lines or sender information.
b. We will identify marketing messages as advertising where required.
c. We will include the physical address of our business.
d. We will honor opt-out and unsubscribe requests promptly.
e. We will allow you to unsubscribe using the link at the bottom of each marketing email.
If you would like to unsubscribe from future marketing emails, follow the instructions at the bottom of any such email, or contact us using the details in Section 17, and we will promptly remove you from our marketing correspondence. Please note that we may still send you transactional or account-related messages that are necessary to provide the Resources.
16. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you by email or through a notice on our website. Your continued use of the Resources after the changes take effect constitutes your acceptance of the revised Policy.
